General terms and conditions of the company:

Contractual partner of the buyer or customer is the sole proprietorship Sascha Groos - Second Broadcast e.K .. In the following company Second Broadcast e.K. named.

1. General

All services provided by Second Broadcast e.K. for the customer are provided exclusively on the basis of the following general terms and conditions. Deviating regulations are only valid if they are between Second Broadcast e.K. and the customer have been agreed in writing.

2. Conclusion of the contract

Only persons who have reached the age of 18 and are not restricted in their legal capacity at the time of the conclusion of the contract are entitled to conclude a contract. The offer is generally aimed exclusively at commercial customers.

a)

The offers of the online shop of Second Broadcast e.K. on the Internet are a non-binding invitation to the customer to order goods in the online shop.

b)

The customer submits a binding offer to conclude a purchase contract when he orders goods on the Internet.

c)

The company Second Broadcast e.K. is entitled to accept this offer within 14 calendar days by sending an order confirmation. The order confirmation is given in writing by Second Broadcast. If the 14-day period has expired without an answer, the offer is deemed to have been rejected.

3. Delivery times

All items are delivered immediately, provided they are available from stock and only while stocks last.

The delivery takes place only within Germany and within the European area. The delivery time is a maximum of 14 working days, unless it is expressly pointed out that it is a longer delivery time, and begins with the dispatch of the order confirmation. The specification of the delivery time is non-binding, unless there is a different written agreement.

If an article is not available at short notice, we will inform you by e-mail about the expected delivery time, provided we have your address.

Some articles have a longer delivery time, these are marked separately, whereby the marking does not indicate a binding delivery date, but is only an estimate.

In the event of delays in delivery, e.g. due to force majeure, traffic disruptions, as well as delays on the part of the transport company and orders from high hand as well as others from the company Second Broadcast e.K. For events beyond the control, no claim for damages can be made against Second Broadcast.

4. Packaging and shipping costs

For delivery within Germany and packaging costs, Second Broadcast e.K. a proportionate amount that depends on the size, quality and value of the item in question. The shipping costs are generally invoiced to the customer.

At the customer's request, express deliveries can also be carried out. The customer bears the resulting additional costs.

5. Prices and payment

5.1

All prices quoted are net prices. The statutory value added tax of currently 19% (from 01.07.2020 to 31.12.2020 the VAT will be temporarily reduced from 19% to 16%) will be shown separately on the invoice.

5.2

The final prices do not include the costs for packaging and shipping.

5.3

Due to the constant updating of the internet pages of the online shop, information given at an earlier point in time regarding the price and quality of the goods lose their validity

5.4

The price shown at the time the customer submits the offer is decisive for invoicing.

5.5

The goods are paid for in advance. Exceptions are only valid if they have been agreed in writing between the online shop and the customer.

5.6

If a different method of payment has been agreed between Second Broadcast and the customer, the customer is obliged to pay the invoice amount within 8 days of receipt of the goods.

5.7

If the customer has not met his payment obligation after the period mentioned in paragraph 5.6 has expired, Second Broadcast e.K. reserves the right to invoice the customer for any resulting additional reminder and processing fees.

5.8

If the customer defaults on payment, Second Broadcast e.K. entitled to claim interest on arrears in the amount prescribed by law. Second Broadcast's right to make any further claims for damages remains unaffected.

6. Reservation of title

6.1

The ordered goods remain the property of Second Broadcast e.K. until full payment has been made. (Retention of title according to §§ 158, 449 BGB). Prior to the transfer of ownership, a disposition or pledge, assignment by way of security, processing or redesign of the goods without the express consent of Second Broadcast E.K. not allowed.

7. Guarantee

7.1

In general, the guarantee or warranty claim is excluded, as is possible among business people. Unless a guarantee or warranty claim is made in writing between Second Broadcast e.K. and the business partner (customer) and recorded in writing. The CCD block of camcorders is generally excluded from any guarantee or warranty claims.

7.2

The customer's claims against Second Broadcast e.K. based on a defect in the goods. must be reported in writing immediately upon receipt of the goods or within the warranty period confirmed in writing.

7.3

The statutory warranty period applies to non-commercial customers.

7.4

The customer undertakes to inspect the goods upon receipt for any defects, in particular transport damage, and to notify them within 3 working days if such a Second Broadcast e.K. is detected. If the customer fails to report a defect within this time, the goods are considered approved and accepted.

7.5

A defect in the goods does not include damage caused by the customer through improper or non-contractual treatment. The information provided by the manufacturer of the goods is decisive for the inappropriateness and lack of conformity with the contract.

7.6

When picking up on site at the premises of Second Broadcast e.K. or through personal delivery by Second Broadcast e.K., the item is deemed to have been properly accepted.

7.7

If necessary The warranty granted does not extend to wear and tear.

7.8

If changes, repairs or applications (e.g. software changes) are improperly carried out on the respective item by the customer or a third party, the liability and the consequences resulting therefrom are canceled and excluded.

7.9

If a warranty is granted, the buyer has Second Broadcast e.K. to give the necessary time and opportunity to remedy the defect.Otherwise the warranty claim does not apply

7.10

Second Broadcast e.K. reserves the right to have the item repaired three times free of charge, or a partial or complete replacement of the item.

7.11

If defects cannot be remedied within a reasonable time, the customer has the right to change or reduce the purchase price.

7.12

In the event of a warranty claim, the customer bears the costs of the outward and return transport. The customer also bears the transport risk. Transport insurance will only take place at the express request of the customer, which in turn must be available in writing.

7.13

Any guarantee or warranty claims are non-transferable and expressly apply only to the buyer of the item at Second Broadcast e.K ..

8. Liability

8.1

Second Broadcast e.K. is liable in cases of intent or gross negligence in accordance with the statutory provisions. The liability for guarantees is independent of fault. Second Broadcast e.K. is liable for slight negligence. exclusively in accordance with the provisions of the Product Liability Act, due to injury to life, limb or health or due to the breach of essential contractual obligations. The claim for damages for the slightly negligent breach of essential contractual obligations is limited to the contract-typical, foreseeable damage, unless liability is due to injury to life, body or health. Second Broadcast is liable to the same extent for the fault of vicarious agents and representatives.

8.2

The regulation of the preceding paragraph (8.1) extends to compensation for damages in addition to the service, the compensation for damages instead of the service and the claim for compensation for futile expenses, regardless of the legal reason, including liability for defects, delay or impossibility.

8.3

The customer has no claims to compensation for damage that did not occur to the product itself, such as production downtime, loss of use and / or data, loss of orders, lost profit or other indirect or consequential damage.

9. Transfer of risk

9.1

The risk is transferred to the customer when leaving the premises or when the goods are dispatched. Transport insurance must be communicated in writing by the customer immediately.

15. Severability clause

Should individual provisions of this contract be or become ineffective or void, this shall not affect the validity of the remaining provisions of this contract.
